45 CFR § 164.504(e): Business associate contracts must specify that the business associate will not use or further disclose PHI other than as permitted or required by the contract. Most AI vendors can't meet this requirement with their current data practices.
45 CFR § 164.308(a)(4): Information access management must implement policies and procedures for authorizing access to PHI. Shared-cloud environments make true access authorization nearly impossible.
